These Terms of Service ("Terms") govern your use of Perpetua Cryptograph, a self-custody cryptocurrency wallet application for Apple Watch and iPhone (the "App"). The App is provided by Perpetua Labs LLC, a Wyoming limited liability company ("Perpetua," "we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
The Service
Perpetua Cryptograph is a non-custodial cryptocurrency wallet that generates and stores private keys on your Apple Watch using the device's Secure Enclave. The App allows you to view balances, receive cryptocurrency, and sign blockchain transactions.
We provide the software. You are solely responsible for your private keys, seed phrase, Recovery Sheet, and all transactions you authorize.
Self-Custody
The App is an unhosted, non-custodial wallet. Your private keys are generated and stored exclusively on your device. We do not have access to your private keys, seed phrase, or funds. This means:
- We cannot recover your wallet if you lose your seed phrase or Recovery Sheet
- We cannot reverse or modify transactions — all blockchain transactions are final and irreversible
- We cannot freeze, access, or transfer your funds — only you control your assets
You are responsible for securely backing up your seed phrase and Recovery Sheet. If you lose access to these backups and your devices, your funds will be permanently inaccessible. No party — including Perpetua, Apple, or any blockchain network — can recover them for you.
Third-Party Services
The App relies on third-party infrastructure to function, including blockchain nodes, RPC providers, price data APIs, and push notification services. These services are provided by independent third parties with their own terms and privacy practices.
We do not control these third-party services and are not responsible for their availability, accuracy, or security. Third-party providers may change, experience downtime, or discontinue service without notice. You acknowledge that your use of the App depends on these external services.

No Financial Advice
The App is a software tool, not a financial service. Nothing in the App or our communications constitutes financial, investment, tax, or legal advice. We do not recommend any cryptocurrency, token, protocol, or investment strategy.
Cryptocurrency markets are volatile and unpredictable. You should conduct your own research and consult qualified professionals before making any financial decisions.
Accuracy of Information
The App displays balances, prices, and transaction data obtained from third-party sources. While we strive to present accurate information, we do not guarantee the accuracy, completeness, or timeliness of any data displayed in the App.
You should independently verify all transaction details before signing, and confirm important transactions through block explorers or other sources.
Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any defects will be corrected or that the App will meet your requirements.
Limitation of Liability
To the fullest extent permitted by law, Perpetua and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of funds, whether due to theft, user error, software bugs, or any other cause
- Unauthorized access to your wallet or devices
- Transactions you did not intend to authorize
- Errors, bugs, or interruptions in the App or third-party services
- Losses resulting from market movements or cryptocurrency price fluctuations
- Actions taken by blockchain networks, miners, validators, or smart contracts
- Any other losses arising from your use of the App
In no event shall our total liability exceed the amount you paid us for the App, if any.
Indemnification
You agree to indemnify, defend, and hold harmless Perpetua and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any applicable law or regulation.
Prohibited Uses
You agree not to use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation. You are solely responsible for ensuring your use of the App complies with all laws applicable to you.
Intellectual Property
The App, including its design, code, graphics, and content, is owned by Perpetua and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except for the limited license to use the App for its intended purpose.
Certain components of the App are open source and subject to their respective licenses. See our Open Source page for details.
Modifications to the App and Terms
We may modify, update, or discontinue the App at any time without notice. We may also modify these Terms by posting the revised version on this page. The "Last updated" date at the top of this page indicates when the Terms were last revised.
Your continued use of the App after any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App.
Termination
You may stop using the App at any time. We may terminate or suspend your access to the App at any time, for any reason, without notice. Upon termination, your right to use the App ceases immediately.
Termination does not affect your ownership of your private keys or funds. Your wallet and assets remain accessible through your seed phrase or Recovery Sheet, independent of our services.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.
General Provisions
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms constitute the entire agreement between you and Perpetua regarding your use of the App and supersede any prior agreements.
